USCIS Increases EB-5 Filing Fees Effective November 30, 2026

USCIS has announced significant EB-5 filing fee increases effective November 30, 2026, including higher fees for Forms I-526, I-526E, and I-829.

On September 29, 2026, U.S. Citizenship and Immigration Services (USCIS) announced a new fee schedule for the EB-5 Immigrant Investor Program. The increased fees will take effect on November 30, 2026 and will apply to filings submitted on or after that date. The final rule follows a program-specific fee study required under the EB-5 Reform and Integrity Act of 2022. USCIS states that the revised fees are intended to recover the costs of administering the EB-5 program, support statutory processing goals, and fund enhanced program integrity measures.

For individual EB-5 investors, the most significant fee increases include:

The new Form I-526 and I-526E filing fees include the newly established EB-5 Technology Fee. The I-526 filing fee represents an increase of approximately 107%, while the initial I-526E filing fee increases by approximately 114%. The Form I-829 filing fee will increase by approximately 33%.

What This Means for EB-5 Investors

EB-5 investors who are already preparing an I-526 or I-526E petition should be aware of the November 30 effective date when considering their filing timeline. Petitions filed before the new fee schedule takes effect will remain subject to the current filing fees, while filings made on or after November 30 will require the increased fees.

Likewise, conditional permanent residents approaching the stage of filing Form I-829 to remove conditions on their residence should account for the increased $5,000 filing fee if their petition will be submitted on or after November 30, 2026.

As always, filing timing should be based on an investor’s individual circumstances and readiness to submit a complete petition, rather than filing prematurely solely to avoid a fee increase.
